The Albanese Labor government has implemented landmark workplace reforms through the Closing Loopholes Act 2023 and Closing Loopholes No. 2 Act 2024. One year after the second tranche passed Parliament in February 2024, these changes are already delivering better work-life balance, improved job security, and enhanced workplace conditions for millions of Australians.



"The Albanese Government's Closing Loopholes reforms brought in world-leading protections for workers," said Minister for Employment and Workplace Relations Murray Watt. "Labor is proud of the changes we have made to improve conditions and lift wages, and everywhere I go I meet workers who are benefiting."

The comprehensive package of reforms has been implemented in stages, with most provisions for medium and large businesses commencing from February 2024, while small businesses will follow from August 2025. This staged approach ensures businesses have adequate time to adapt to the new requirements.

Right to Disconnect

For the first time, Australian workers have a legislated right to refuse unreasonable contact outside of working hours, addressing the growing problem of unpaid overtime and digital burnout. This provision, which commenced on 26 August 2024 for medium and large businesses, allows workers to genuinely disconnect from work during personal time without fear of repercussions.

Gig Economy Protections

Australia now leads the world with minimum standards for digital platform workers. The Fair Work Commission has been empowered to set minimum standards for gig workers, protecting them from unfair deactivation and ensuring decent pay and conditions. The first four applications under these changes have already been submitted to the Fair Work Commission, with industry consultation underway.

Casual Employment Reform

The legislation ends the concept of "forced permanent casual" by redefining casual employment and providing genuine pathways to permanent work. This addresses the growing insecurity faced by the more than 2.6 million Australians in casual roles and simplifies the conversion process for employers.

Transport Industry Standards

New provisions ensure a safe, sustainable, and viable trucking industry by allowing the Fair Work Commission to set minimum standards. From February 2025, truck drivers must be given fair process before contract termination through the new Road Transport Industry Termination Code.

Additional Worker Protections

The legislation also strengthens workplace rights by:

  • Allowing workers to challenge unfair contractual terms

  • Implementing stronger penalties for sham contracting

  • Enabling multiple franchisees to access single enterprise agreement streams

  • Strengthening right of entry provisions to investigate underpayments

  • Clarifying the meaning of 'employee' and 'employer' in the Fair Work Act

Real Benefits for Australian Workers

The reforms are already making meaningful differences in workers' lives, as evidenced by testimonials from those benefiting from the changes:

"We now have world-leading transport and gig worker protections. These new rights will protect me from unfair deactivation and ensure decent pay and conditions for the first time," explains Nabin, a gig worker from the ACT. "Some workers are earning as little as $4 per job and working 70+ hours a week to make ends meet."

Anna, an aged care worker from WA, shares: "The Right to Disconnect from work is life-changing for workers in Home Care like me. It gives us time to spend with our loved ones so that when we come back to the next shift, we are rested and ready to care for elderly Australians."

Driving Economic Benefits

The reforms come as the Australian economy sees positive wage growth. Under the Albanese government, wages are now growing at 4 percent—the highest in 15 years—with two consecutive quarters of real wage growth.

Minister Burke highlighted the broader economic benefits: "The Government is getting wages moving. Under the Albanese Labor Government, there are more people in jobs, they're earning more, and under our tax cut plan, they'll keep more of what they earn."
